Terms of use

 

These Terms of Use govern the terms and conditions of use of the online store provided by Yanagihara Cooking School. By visiting our site or using any of our services, you agree to be bound by these terms and conditions. Please read them carefully.

 

Article 1 (Application)

  1. These Terms of Use shall apply to all relations between the user and us concerning the use of this service.
  2. In addition to these Terms of Use, we may establish various rules and regulations regarding the use of this service. These Individual Regulations shall constitute a part of this Agreement, regardless of the name by which they are called.
  3. In the event that the provisions of this Agreement conflict with the provisions of the Individual Rules set forth in the preceding paragraph, the provisions of the Individual Rules shall take precedence unless otherwise specified in the Individual Rules.

 

Article 2 (Registration for Use)

  1. In this service, registration for use is completed when a prospective registrant agrees to these Terms of Use and applies for registration for use in the manner prescribed by the Company, and when the Company notifies the prospective registrant of its approval of the application.
  2. We may not approve an application for registration if we determine that the applicant has any of the following reasons, and we are under no obligation to disclose the reasons for such denial.

(1) When false information is reported at the time of application for registration.

(2) If the application is from a person who has violated these Terms of Use

(3) In any other case in which we deem the registration of use to be inappropriate.

 

Article 3 (User ID and Password Management)

  1. The User shall manage his/her User ID and password for this service under his/her own responsibility.
  2. The User shall not, under any circumstances, transfer, lend or share the User ID and password with any third party. If a User logs in using the same User ID and password combination as the registered information, we will consider the use of this Service to be by the User who registered the User ID.
  3. We shall not be liable for any damage caused by the use of user IDs and passwords by third parties, except in the case of willful misconduct or gross negligence on our part.

 

Article 4 (Purchase Agreement)

  1. In this service, a purchase contract shall be formed when a user makes a purchase application to us and we notify the user that we have accepted the application. Ownership of the product shall be transferred to the user when we deliver the product to the delivery company.
  2. We may cancel the purchase agreement described in the preceding paragraph without prior notice to the user if any of the following events occurs.

(1) If the user violates these Terms of Use

(2) If the product delivery is not completed because the delivery address is unknown or the user is absent for a long period of time

(3) In any other cases where we deems that the relationship of trust between us and the user has been damaged.

(4) The method of payment, delivery, cancellation of a purchase order, or return of goods related to this service shall be in accordance with the method separately determined by us.

 

Article 5 (Intellectual Property Rights)

The copyrights or other intellectual property rights to product photos and other content provided through this service are the property of Yanagihara Cooking School, content providers, or other legitimate right holders, and users may not reproduce, reprint, modify, or make any other secondary use of such content without permission.

 

Article 6 (Prohibited actions)

In using this service, the user shall not engage in any of the following acts.

(1) Acts that violate laws, ordinances, or public order and morals

(2) Criminal acts

(3) Infringement of copyrights, trademarks, or other intellectual property rights contained in this service

(4) Acts that destroy or interfere with the functions of this service's server or network

(5) Commercial use of information obtained from this service

(6) Acts that may interfere with the operation of this service

(7) Acts of gaining or attempting to gain unauthorized access to this service

(8) Acts of collecting or accumulating personal information about other users

(9) Acts of impersonating other users

(10) Act of providing benefits directly or indirectly to antisocial forces in relation to this service

(11) Any other acts that we deems inappropriate.

 

Article 7 (Suspension of the Service, etc.)

  1. We reserve the right to suspend or discontinue all or part of this Service without prior notice to users for any of the following reasons
    • When performing maintenance, inspection, or updating of the computer system related to this service
    • When the provision of this service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    • When computers or telecommunication lines are stopped due to an accident
    • In any other cases where we deem it difficult to provide this service. 2.
  2. We shall not be liable for any disadvantage or damage incurred by users or a third party due to the suspension or interruption of this service, regardless of the reason.

 

Article 8 (Restriction of use and cancellation of registration)

  1. We reserve the right to restrict your use of all or part of the Service or terminate your registration as a user without prior notice in any of the following cases
    • If you violate any of the provisions of this Agreement.
    • If any false information is found in the registration information
    • In the event that the credit card the user has submitted as a means of payment is suspended.
    • If users defaults on payment of fees or other obligations.
    • If users fails to respond to our communications.
    • If users has not used this service for a certain period of time since the last use
    • In any other cases where we deem the use of this service to be inappropriate.
  2. We shall not be liable for any damages incurred by users as a result of any action taken by us under this Article.

 

Article 9 (Cancellation of membership)

Users may withdraw from this service through the prescribed withdrawal procedure.

 

Article 10 (Disclaimer of Warranty and Liability)

  1. We do not warrant that this service is free from defects in fact or law.
  2. We shall not be liable for any damages incurred by users as a result of this service. However, if the contract between us and users regarding this service is a consumer contract as defined in the Consumer Contract Act, this disclaimer does not apply, and even in this case, we shall not be liable for any damages arising from special circumstances among damages caused to the user due to default of obligation or tort caused by our negligence.
  3. We shall not be liable for any transaction, communication or dispute between a user and another user or a third party in connection with the Service.

 

Article 11 (Changes in Service Content, etc.)

We may change the content of this service or discontinue this service without notice to users, and shall not be liable for any damages incurred by users as a result of such changes or discontinuation.

 

Article 12 (Modification of the Terms of Use)

We may modify the Terms of Use at any time without notice to users if we deems it necessary. If users starts to use this service after the modification of the Terms of Use, users shall be deemed to have agreed to the modified Terms of Use.

 

Article 13 (Handling of Personal Information)

We shall properly handle personal information obtained through the use of this service in accordance with our "Privacy Policy".

 

Article 14 (Notice or Communication)

Notices or communications between users and us will be made in a manner determined by us.

 

Unless a user notifies us of a change in his or her contact information in accordance with a method determined separately by us, we will assume that the currently registered contact information is valid and send notices or communications to that contact information, which will be deemed to have reached the user at the time of transmission.

 

Article 15 (Prohibition of assignment of rights and obligations)

Users may not transfer or offer as collateral their positions under the Terms of Use or their rights or obligations under the Terms of Use to any third party without our prior written consent.

 

Article 16 (Applicable Law and Jurisdiction)

This Agreement shall be governed by and construed in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this service.

In the event of any dispute arising in connection with this service, the court having jurisdiction over the location of our head office shall be the court of exclusive jurisdiction.
